Client trips in back yard

The case:

Our client was employed as a support worker in a building containing multiple flats. Whilst walking back to her onsite office which was in the back yard of the building on a dark and rainy evening, she tripped on a piece of plywood in the yard and fell.

She suffered from soft tissue damage, pain and swelling to her right knee and required pain medication and crutches for 3 weeks. The pain continued beyond this period which led to 8 sessions of physiotherapy over a 12-month period.

15 separate issues in the workplace were pleaded and after litigation commenced the Defendant conceded their position and settled the claim after it was brought to light that the failure of the security lights contributed to the trip, with other members of staff previously having fallen in the same location.
