Injured cyclist awarded compensation more than double that of the defendant’s final offer.

What happened?

Our client was travelling on his push bike when he was hit by a motorist pulling out of their driveway. He was consequently thrown off his bike and flew over the bonnet of the car, causing multiple injuries. He fractured his nose, suffered post-concussion syndrome and sustained soft tissue injuries to his right shoulder, arm and thumb.

The defendant’s insurer in this case made a final offer to settle the case at £3509 – a valuation that we deemed to be considerably less than what we would accept as an appropriate settlement for a claim of this nature. For this reason we advised our client to reject the insurer’s offer and to commence court proceedings – which we went on to do.

The judge awarded a compensation settlement of £7359, more than double that of the defendant’s final offer of £3509. This included obtaining an interim payment of £2463 to the client to cover damages caused by their physical injuries and bike damage repair costs incurred due to the accident.
