Mr. C was cycling with three friends when a car that was travelling in the opposite direction turned right and knocked him off his bike. Mr. C’s road bike was damaged beyond repair and he sustained multiple cuts and bruises and soft tissue injuries to his shoulder, wrist and neck.
The claim should have been straightforward because there was little doubt about who caused the accident, however the car driver would not accept she was responsible and so her insurance company refused to pay out.
Even though we obtained evidence to prove our client’s claim; witness statements from Mr. C’s friends and from the driver of a passing car who was kind enough to stop, together with a report from the police who attended the accident scene, the insurance company still refused to deal with Mr. C’s claim.
It was not until court proceedings were commenced and a date set for trial at York County Court that the insurance company realised the futility of its position and settled Mr. C’s claim in full. This included compensation for his injuries, a replacement bike, damaged clothes and equipment, and loss of earnings.
