Can I make a claim for someone without capacity?

It is possible to make a clinical negligence claim on behalf of someone else if they have been confirmed as being without capacity by a medical professional in certain circumstances:

  • You should ideally be the next of kin 
  • Or you have a Power of Attorney over their affairs
  • Or if the injured person is under the age of 18, and you are the next of kin
