What is a no win, no fee agreement?

A no win, no fee agreement, otherwise known as a ‘conditional fee’ agreement, is an arrangement between you (the client) and your solicitor when making a legal claim. Simply put it means that should your claim be unsuccessful, you will not be liable to pay the fees for your solicitor’s services (as long as you have co-operated and followed their advice). You will only pay legal fees if your claim is successful.

  • 1. How does no win, no fee work? When entering into a no win, no fee agreement we will complete an initial assessment of your claim, advising you on the merits of your case. If we do not feel that your case is worth pursuing we will advise you, along with the reasons why. If you have a viable claim, which we can handle on a no win, no fee basis, we will take out an insurance policy on your behalf. The insurance policy, known as After the Event insurance (ATE) is in place to cover any additional costs incurred, such as court fees or medical report payments. The policy protects you against these risks and means that, whether you win or lose, provided you comply with the terms of the policy, you will not have to pay your opponents legal costs. Your claims handler will fully explain the terms of the policy to you at the start of the claims process.
  • 2. What can I make a no win, no fee claim for? If someone else is to blame for your injury or illness you are likely to be able to make a claim for compensation. True Solicitors are experienced in handling the following types of claims on a no win, no fee basis:

  • 3. What fees will I have to pay if I win my claim? The majority of the legal costs incurred in your case will be recovered from the person, or company responsible for causing your accident or injury – in most cases this will be covered by their insurer. Other costs will be covered by what is known as a ‘success fee’ for your solicitor’s services. This is typically a percentage of the compensation obtained and will be agreed with yourself at the start of the process. Our success fee ranges from 25% to 30% (+VAT) of the compensation settlement, depending on the type of claim and whether court proceedings are issued. You will also be required to pay for the ATE insurance premium that is in place to cover any additional costs incurred, such as court fees or medical report payments.
  • 4. What will happen if I lose my no win, no fee claim? A no win, no fee agreement means that if your case is unsuccessful you will not be required to pay any legal fees, subject to you complying with the terms and conditions set out in your ATE insurance policy. Your claims handler will fully explain these to you at the start of your claim. Should your claim be unsuccessful, your insurance policy protects you against having to pay your opponents legal costs and fees.
