Failure in nursing care case

The case:

Our client having suffered a cerebral bleed and subsequent stoke, had been admitted to hospital and was recovering in a neurological rehabilitation ward.

She underwent a tracheostomy which restricted her ability to communicate vocally, and due to her incapacity to stand or walk unassisted, should have always had one to one nursing care.

Finding herself in need of the toilet, she attempted to attract the attention of the nursing staff to assist her, and having failed, she managed to manoeuvre over to the commode located 3-4 feet away from her bed. After using the commode, she once again attempted several times to motion to the staff to attract attention for assistance in returning to her bed. Failing to do so, she tried to return to bed by herself and in the process of doing so, fell and broke her clavicle.
